8.4 Planned transborder flows of personal information
Yes. Shopify (website, form and order information), Google (analytics and advertising information) and Meta (WhatsApp messages, and advertising information), and possibly our payment provider, store or process personal information outside the Republic. We send it to them because it is necessary to answer requests and do the jobs customers ask for, because these providers are bound by data-processing terms that require them to protect it, and, for analytics and advertising, because the visitor consented (section 72 of POPIA).
8.5 Security measures
- Our website is served over an encrypted connection (HTTPS).
- Card and instant-EFT payments are processed by our payment provider; we never see or store full card numbers.
- Only the people who need personal information for their work can access it, and our accounts and devices are protected with passwords.
- Analytics and advertising tools run only as far as each visitor's cookie choice allows.
- If we believe personal information has been accessed without authority, we notify the Regulator and the people affected, as section 22 of POPIA requires.
9. How to request access to a record
- Complete Form 2 of the PAIA Regulations (request for access to a record). It is available on the Regulator's website, or from us on request.
- Send it to our Information Officer at info@loadandgo.co.za. Describe the record in enough detail for us to find it, include proof of your identity, and, if you are asking on behalf of someone else, proof of your authority to do so.
- Say which of your rights you want to exercise or protect, and explain why you need the record for it. Section 50 of PAIA gives access to a record of a private body when it is required for the exercise or protection of a right.
- Pay the request fee, and any access fee, prescribed in the PAIA Regulations. The fee structure is published on the Regulator's website. If the search will take more than six hours, we may ask for a deposit of not more than one third of the access fee.
- We decide within 30 days and tell you our decision and any fee payable. We may extend this once by up to 30 days and will tell you if we do. If we do not reply in time, the request is treated as refused.
We may refuse access only on the grounds in sections 63 to 69 of PAIA, which protect: the privacy of a third party who is a natural person; the commercial information of a third party; confidential information of a third party; the safety of individuals and the protection of property; records privileged from production in legal proceedings; the Company's own commercial information; and research information. Where only part of a record is protected, we will consider giving access to the rest. Even where one of those grounds applies, section 70 of PAIA requires us to give access if the record would reveal evidence of a substantial contravention of the law or an imminent and serious public safety or environmental risk, and the public interest in disclosure clearly outweighs the harm.
If you are not satisfied with our decision, you may complain to the Regulator (Form 5) within 180 days of receiving it, or apply to court within 180 days. There is no internal appeal against a decision of a private body.
To ask for your own personal information, or to have it corrected or deleted, you can also use the route in our privacy policy.
